Do You Need a Lawyer?

School sexual abuse often comes down to the fault of the larger educational institution, such as a public school district. It is the institution’s responsibility to hire safe teachers, respond quickly to sexual misconduct allegations and to safeguard students. Any breaches of these duties could lead to legal responsibility for sexual abuse falling on the district. Going up against a public school district, however, can be difficult for survivors and their families without help from an attorney.

When you hire a sexual abuse lawyer from Manly, Stewart & Finaldi, you benefit from the attention of an experienced attorney on your case. Our professionals can use their past experiences and in-depth subject area knowledge to guide you successfully through your case. We can handle the legal legwork of your school sexual abuse case against a Monterey County school district while you concentrate on trying to heal and move forward.

What AB-218 Means as a Public School Sexual Abuse Survivor in California

Under previous California law, public school sexual abuse survivors and others who suffered childhood sexual assault under a government entity only had six months to one year to file their claims. The California Government Tort Claims Act applied to these cases, imposing a strict deadline. Although a law in 2008 changed this deadline, it only applied to survivors who experienced abuse after January 1st, 2009.

In 2009, the California Legislature amended the requirement with AB-218. As of January 1st, 2020, survivors of childhood sexual assault with cases prior to January 1st, 2009 may file their claims without the requirements of the Tort Claims Act. If you are a survivor of assault from a public school in Monterey County, it is important to seek legal advice right away from the professionals at Manly, Stewart & Finaldi.

Compensation Available for Victims of School Sexual Abuse

Experiencing sexual assault as a student can be life-changing. You may never feel the same emotionally or psychologically. Adult survivors of childhood sexual abuse often suffer from depression, anxiety and other mental health disorders. It is your time to come forward, demand justice and obtain compensation for the harm you have suffered.

A successful personal injury lawsuit can provide closure, achieve justice for your child, as well as financial compensation for your out-of-pocket costs associated with the abuse, including medical care, antidepressants, other medications, therapy costs, lost wages and legal fees. It could also compensate you for noneconomic harm, such as physical pain and suffering, emotional distress, mental anguish, and psychological suffering.
