Statute of Limitations for Filing a Claim
Child Sexual Assault
Effective January 1, 2024, Assembly Bill (AB) 452, eliminated the statute of limitations on a child sexual abuse or assault lawsuit in California. This means that a survivor will be able to sue a child sexual predator no matter how many years have passed from the date of the crime.
While it will not retroactively apply to cases brought forward prior to 2024, it will apply to all civil child sexual abuse allegations moving forward.
Adult Sexual Assault
Under Cal. Code Civ. Proc. § 340.16, those 18 years of age or older when the assault or abuse happened can bring a civil case within the following time frames:
- Within 10 years from the date of the last act, attempted act, or assault with the intent to commit an act, of sexual assault against the plaintiff.
- Within three years from the date the plaintiff discovers or reasonably should have discovered that an injury or illness resulted from an act, attempted act, or assault with the intent to commit an act, of sexual assault against the plaintiff.
