About the USC Gynecologist Sexual Abuse Case

In 2019 and 2020, hundreds of women came forward against the former USC campus gynecologist George Tyndall, calling him a sexual predator that used his position of power to sexually abuse them. Their accounts of his crimes include conducting unnecessary physical exams, touching patients inappropriately, penetrating his patients digitally, performing exams without a nurse chaperone present, taking photographs of their genitals, and making sexist comments.

The survivors also condemned USC in their lawsuit for continuing to give Tyndall unregulated access to young female students even after numerous complaints of his sexually inappropriate behaviors. The civil case was against both the University and Dr. George Tyndall. Tyndall is currently facing 11 counts of sexual assault and battery. If convicted of all crimes, he could face up to 64 years in prison.

In March 2021, the civil case against former USC gynecologist George Tyndall settled for a historic $852 million for 710 survivors – the largest sexual abuse settlement against any university in history. Manly, Stewart & Finaldi represented the largest number of survivors (234) in this case and were the lead counsel.

When Can You Hold a School or Institution Responsible?

In the civil lawsuit against Dr. George Tyndall, the plaintiff’s side of the case met their burden of proof in establishing that USC knew about the complaints against the gynecologist but did nothing to protect its students. USC ignored the complaints and continued to allow Tyndall to treat patients and perform examinations without supervision. It was only when a nurse chaperone complained about Tyndall’s behaviors that the gynecologist stepped down from the university.

As a sexual abuse or assault survivor, you may have grounds to file a claim not only against an individual perpetrator but also an institution if that institution should have done more to protect you but negligently failed to do so. All schools and educational institutions have a legal obligation to protect their students. Failing to do so, resulting in student sexual abuse or assault, is the definition of negligence.

If there was a history of complaints by other students against a campus doctor, for example, but the school continuously failed to take action to resolve the issue or protect its students, the school could be held legally responsible for resultant sexual abuse and assault. Holding a school accountable can push for changes on an institutional level, as well as result in just financial compensation for survivors.
