California Historically Treated Claims Against Public School Districts Differently

The passing of AB-218 into law has changed the way California civil courts handle claims against public school districts for childhood sexual assault. In the past, claimants had to abide by the strict rules of the California Government Tort Claims Act – including a six-month deadline on most claims. Failing to bring a claim within six months after the last date of abuse could previously mean no right to file at all.

AB-218, however, has amended the law so that student sexual abuse survivors now have more time – until age 40 – to bring their claims. A law in 2008 made a similar exception, but only for claimants whose abuse occurred on or after January 1st, 2009. AB-218 extends the exception to all childhood sexual assault survivors, including those with cases of abuse documented before January 1st, 2009.
