Why Civil Lawsuits Against Public School Districts for Childhood Sexual Assault Historically Looked Different Than the Same Suits Against Private Parties

In California, previous laws created a challenge for survivors who experienced assault at public schools. Since public school districts are part of the government, the California Tort Claim Act applied to these cases. Survivors had strict time limits of just six months – or one year in some cases – to file their claims before losing the right to seek damages forever. 

In 2008, a law passed changing the statute of limitations on claims against the government for childhood sexual assault survivors, but only for assaults that occurred after January 1st, 2009. Recently, however, the California Legislature passed Assembly Bill 218, which changed the statute of limitations on cases occurring before January 1st, 2009 as well.

Upon AB-218 taking effect on January 1st, 2020, survivors who suffered sexual assault by a teacher, administrator or another employee or volunteer at a public school will no longer need to abide by the Tort Claims time limit requirement.
